AN approves in first discussion the Simón Bolívar Special Law against the Blockade

It was approved in a first discussion the Liberator Simón Bolívar Organic Law Against the Imperialist Blockade and for the Defense of the Bolivarian Republic of Venezuela. In this regard, Deputy Carlos Mogollón (PSUV-Distrito Capital), indicated that this legislation originates as a legal instrument of justice for the Venezuelan people, who suffer from the unilateral coercive measures of the United States, as well as the confiscation of public assets.

The regulation consists of 18 articles, and proposes the political disqualification of natural and legal persons who support the imposition of sanctions against Venezuela. Likewise, Mogollón indicated that the legislation «includes the product of the debate of the previous session» and that it proposes the disqualification «up to double the maximum penalty for those who help or ally with foreign countries to impose sanctions against the people of Venezuela.»

In addition, he pointed out that this regulation catalyzes the application of the Law of Extension of Domain for all those people who «promote, participate, disseminate, make an apology» for unilateral coercive measures against the Venezuelan people; which also constitutes an aggravating factor for the crime of treason.

In the same instance, the legislation raises a case where the defendant in a contumacious state refuses to attend the preliminary hearing or the oral trial hearings, «it will be understood that he does not want to make use of the rights to be heard in the process, so the respective hearing will be held with his or her defense attorney, who will attend,» said Deputy Mogollón.

In accordance with Article 65 of the Constitution:

Furthermore, if those who commit these crimes refuse to submit to the judicial process, «the Venezuelan people, «invoking the right of the victims of unilateral coercive measures, will judge and condemn them in absentia,» said the legislator. On the other hand, the law states that, in accordance with Article 65 of the Constitution of the Bolivarian Republic of Venezuela, even people who have never served as public officials may be politically disqualified for more than 30 years, if they ally themselves with foreign powers.

The Law respects Article 42 of the Magna Carta:

Later, deputy Iris Varela (PSUV-National), declared that «it is a law expected and longed for by the Venezuelan people, those people who have seen that the mechanisms of justice that they so long for have been elusive.» She also described this as «a simple but forceful law» and proposed the disqualification to be perpetual, which would respect article 42 of the Magna Carta, which establishes that prison sentences should not exceed 30 years. However, she does not omit the possibility of permanent disqualifications.

In addition, the legislator suggested the elimination of all identification and registration documents of the owners of legal entities that lend themselves to committing treason by supporting sanctions against the Venezuelan nation to be studied.
