No illegality: New electoral convocation of the ANC is a Supra-Constitutional act

The clarification was made by the constitutionalist lawyer, Olga Álvarez, who responded to criticism from some right wing spokespersons, clarifying that the call for a new electoral process made by the National Constituent Assembly “is a constitutional, Supra-Constitutional act that is not related to the current internal order, is a plenipotentiary act” of the originary constituent power.

“The National Constituent Assembly is plenipotentiary and its action is Supra-Constitutional. According to article 349, it has the power to transform the State, to create a new legal system and to draft a new Constitution; in that capacity they can perfectly initiate or summon processes to legitimize the authorities at the different levels of the political power”, she emphasized.

Alvarez, during an interview in the “Encendidos” (Turned On) program broadcast by Venezolana de Televisión, said that the call to this new electoral process is part of the efforts to pacify the country, so they have been calling each of the powers -local, state and national- for its legitimation.

“The National Constituent Assembly has acted in such a way that the country is moving towards a process of reconciliation. The violence was overcome with the call to an ANC and the election of the constituents in 2017, and all the acts that have followed have sought to resolve the different edges of the economic war and guarantee peace by renewing the political authorities (…) “
