Constituent Act authorizes the continuation of the prosecution of Freddy Guevara

The National Constituent Assembly (ANC) approved this Monday in a regular session a Constitutional Act authorizing the Supreme Court of Justice (TSJ) to continue with the prosecution of the right-wing leader Freddy Guevara, principal actor of the seditious plan that attempted against the peace of the country between April and July of this year, which left a balance of 124 dead people.

The wight wing deputy incurred in the crime of use of children and adolescents to incur the instigation of hatred, sanctioned by Venezuelan laws.

Constituent act that authorizes the continuation of the trial of the citizen Freddy Alejandro Guevara Cortez

The National Constituent Assembly, in exercise of the powers provided for in articles 347, 348 and 349 of the Constitution of the Bolivarian Republic of Venezuela pursuant to the mandate granted on July 30, two thousand and seventeen in democratic, free, universal, direct and democratic elections secrets by the Venezuelan people as a depository of the original power,

CONSIDERING

That the National Constituent Assembly fulfills the mandate of the sovereign People to realize the supreme values of the Republic of peace, freedom, equality, sovereignty, solidarity, territorial integrity, common good, and pre-eminence of human rights,

CONSIDERING

That all bodies of the Public Power are subordinated to the National Constituent Assembly, as an expression of the original and founding power of the Venezuelan people, in the terms established in the Rules to Guarantee the Full Institutional Functioning of the National Constituent Assembly in Harmony with the Powers Public Constituted,

CONSIDERING

That the Supreme Court of Justice requested authorization from this Sovereign National Constituent Assembly, in compliance with article 349 of the Constitution of the Bolivarian Republic, by means of official letter No. TPE-17-423, dated November 3, 2017, and sent certified copies of the decision issued by the Full Chamber in File AA10-L-2017-000112, referring to the citizen Freddy Alejandro Guevara Cortez, holder of identity card number 18.357.476, for the purpose of determining what is appropriate, as planned in article 200 of the Constitution of the Bolivarian Republic of Venezuela,

CONSIDERING

That the Supreme Court of Justice has established the existence of sufficient evidence to consider that the citizen Freddy Alejandro Guevara Cortez is continuously involved in the crimes of the use of children and adolescents to commit crimes, association and public incitement to hatred , planned and sanctioned in the current penal legislation,

CONSIDERING

That the Commission for Truth, Justice, Peace and Public Peace, in compliance with its mandate, has received different testimonies from victims and persons who intervened in the events of violence with political purposes that took place in our country from April to July 2017, in the which citizen Freddy Alejandro Guevara Cortez is indicated as directly responsible for planning, inciting and executing these punishable acts,

DECIDES:

FIRST. To authorize the continuation of the prosecution of the citizen Freddy Alejandro Guevara Cortez, holder of identity card number 18.357.476, in accordance with the provisions of Article 200 of the Constitution of the Bolivarian Republic of Venezuela.

SECOND. To publish this Constituent Act in the Official Gazette of the Bolivarian Republic of Venezuela and contact the Supreme Court of Justice and the Attorney General of the Republic.

Done and signed in the Protocolary Chamber of the Federal Legislative Palace, Seat of the National Constituent Assembly, in Caracas, on the sixth day of November, two thousand and seventeen. Years 207º of Independence, 158º of the Federation and 18º of the Bolivarian Revolution.
