President Nicolás Maduro offers pardon to political leaders

Presidential decree in which the President of the Bolivarian Republic of Venezuela, Nicolás Maduro, offers pardon to opposition leaders.

“With the supreme commitment and will to achieve the greatest political efficacy and revolutionary quality, in the construction of socialism, the re-founding of the Venezuelan homeland, based on humanistic principles, sustained in moral and ethical conditions, which pursue the progress of the country and the collective

By mandate of the people in accordance with the provisions of Article 236 of the Constitution, and in exercise of the powers conferred on me by numerals 1 and 19 of aforementioned Article 236 thereof.

Considering

That it is a fundamental interest of the Bolivarian Government, the defense and respect of the Constitution of the Bolivarian Republic of Venezuela, and the current legal system, as is evident in the more than 600 calls organized by the President of the Republic to constructive dialogue with all the sectors of political, social and economic life in Venezuela, with the objective of promoting peaceful coexistence and the solution of the controversy through constitutional, electoral, and peaceful channels, as well as the exercise of the broadest freedoms enshrined in the practices democratic

Considering

That the elections called by the Electoral Power so that the people of Venezuela elects, by way of universal, direct, secret, free and sovereign vote, the deputies and deputies of the National Assembly, which will be installed on January 5 2021, constitutes a stellar opportunity to guarantee the widest possible participation of all political parties, and groups of voters that propose to represent the more than 20 million Venezuelans enrolled in the Electoral Registry of Venezuela

Considering

That being heard the opinion of the Commission for Truth, Justice, Peace and Public Tranquility, chaired by the Attorney General of the Republic, and in order to promote national reconciliation, and the incessant search for citizen peace, the National Executive Branch will continue to adopt all the necessary measures to strengthen our democracy and open channels of political action, within the framework established by the Constitution of the Bolivarian Republic of Venezuela and as established by the laws

Considering

That it is the moment for the national union to face the criminal blockade, which through illegal and inhuman actions, contrary to international laws, the United Nations Charter and the peaceful coexistence between nations make up a multiform aggression against all inhabitants of our homeland, peaceful and sovereign. All this within the context of the current Covid-19 pandemic, which has put humanity in suspense and demands the participation of all efforts, beyond creeds and political convictions, to take care of our people and succeed in this fight for the health and life of all

Considering

That the spirit of justice and peace, of the decree with the rank, value and force of a special law of amnesty issued by Commander President Hugo Chávez on December 31, 2007, at the time laid the foundations for the constitutional prosecution of the sectors Politicians and the Consolidation of Leading Democracy in Venezuela

Considering

That in accordance with the Constitution of the Bolivarian Republic of Venezuela and the Organic Code of Criminal Procedure, the President of the Republic, as head of state, is empowered to grant pardons, in any state and degree of the process or the execution of the sentence, resulting in the termination of the criminal action or sentence and the immediate cessation of any measure of personal coercion

Considering

That as constitutional president of the Bolivarian Republic of Venezuela, I am moved by the desire for justice and peace, as well as the firm determination to consolidate democratic and peaceful ways to resolve the controversies between political actors, is why I consciously decide I resolve and decree the following:

Article 2

Refer to the competent jurisdictional bodies an authentic copy of this decree, so that they can adopt the corresponding measures, in accordance with the provisions of the Criminal Procedure Code

Article 3

The police, military and Penitentiary Service bodies must immediately implement the freedom measures agreed upon by the competent courts for the persons mentioned in this decree.

Article 4

The Executive Vice President and the ministers of People’s Power for Penitentiary Services; and for Interior Relations, Justice and Peace, are in charge of the execution of this decree

Article 5

This decree will enter into force, as of its publication in the Official Gazette of the Bolivarian Republic of Venezuela”.
