TSJ annuls unconstitutional acts of the National Assembly


The Supreme Court of Justice (TSJ) annulled the parliamentary acts of the unconstitutional directive of the National Assembly (NA), for maintaining under contempt of the sentence of the Constitutional Chamber of the Judiciary Power.

This was reported on Wednesday through the @TSJ_Venezuela Twitter account, where was shared a press release.

With this, the Constitutional Chamber of the Supreme Court of Venezuela dismissed the declaration of abandonment of the post of the President of the Bolivarian Republic of Venezuela, Nicolás Maduro.

In addition, was annulled the appointment of Julio Borges as Chairman of the NA, a reason why Ramos Allup will have to resume his position, following the sentence by the TSJ.

“In view of the impossibility of performing valid acts, is configured the unconstitutional omission of the National Assembly, so that the President of the Republic in full exercise of his functions, citizen Nicolás Maduro Moros, must render his annual message to the TSJ” , reads the communiqué.

In view of the installation of the National Assembly and the election of a new Board of Directors, on January 5, 2017, while being under contempt of the Judiciary Power, the parliamentary proceedings deployed since that day are also null, including the session of the 9th of that month and Year, in which, in addition to the Constitution, they violated their own Internal and Debates Rules; All in accordance with what was examined in sentences 2 and 3, published on January 11, 2017, by the Constitutional Chamber.

In view of the impossibility to perform valid acts, is configured the unconstitutional omission of the National Assembly, so that the President of the Republic in full exercise of his duties, citizen Nicolás Maduro Moros, must render his annual message to the TSJ, in which he will give an accounting of the political, economic, social and administrative aspects of his management during the immediately preceding year.

The TSJ orders the deputies who are in unconstitutional parliamentary omission, in contempt of several judgments of the Judiciary Power and in permanent violation of values, principles and constitutional norms, to immediately desist from such actions and exercise their attributions according to the Magna Carta and the rest of the legal order, notwithstanding the responsibility these may generate.

The Constitutional Chamber orders the deputies who formed the Board of Directors during the year 2016, that before installing the second session and validly elect the Board of Directors for 2017, they must stop the contempt to the Judiciary Power, in order to make the new directorate legitimate and for the acts of the National Assembly to be valid, in compliance, among others, with the sentences Nos. 808 and 810, dated 2 and 9-09-2016, respectively; The Judgment 952 of November 21, 2016, as well as Decisions 1012, 1013, 1014 of November 25, 2016 and No. 1 of January 6, 2017, in which has been ratified the contempt by the National Assembly to decisions No. 260 of 12-30-2015, 1 of 11-01-2016 and 108 of 01-08-2016, emanating from the Electoral Hall of the TSJ.

Lastly, the Highest Court calls on the various political actors of the Nation to use the means of dialogue as a fundamental tool to resolve political differences and, in particular, to fulfill constitutional duties, purposes and rules, in order to ensure the construction of a just and peace-loving society and to promote the prosperity and welfare of the people; since the constant confrontation in all matters that are their responsibility would ostensibly prejudice the Venezuelan People in general, without any distinction, beginning with the most vulnerable social sectors.
