TSJ declares constitutionality of referendum questions in defense of Guayana Esequiba

The Constitutional Chamber of the Supreme Court of Justice, in ruling 1469 of the Constitutional Chamber, declared the constitutionality of the five questions of the consultation referendum for the defense of Guayana Esequiba.

Likewise, it constitutionally ratifies the content of the five questions, which are:

1) Do you agree to reject, by all means, in accordance with the law, the line fraudulently imposed by the Paris arbitration award of 1899 that seeks to deprive us of our Guayana Esequiba?

2) Do you support the 1966 Geneva Agreement as the only valid legal instrument to reach a practical and satisfactory solution for Venezuela and Guyana regarding the controversy over the territory of Guayana Esequiba?

3) Do you agree with Venezuela’s historical position of not acknowledging the jurisdiction of the International Court of Territorial Justice to resolve the territorial controversy over Guayana Esequiba?

4) Do you agree to oppose, by all means, in accordance with the law, Guyana’s claim, unilaterally, illegally and in violation of International Law, to dispose of a sea, pending delimitation?

5) Do you agree with the creation of the Guayana Esequiba state and the development of an accelerated plan for the integral care of the current and future population of that territory, which includes, among others, the granting of citizenship and identity card? Venezuela, in accordance with the Geneva Agreement and International Law, consequently incorporating said state on the map of Venezuelan territory?


Likewise, the Supreme Court orders the publication of the full text of the aforementioned ruling in the Official Gazette, the Judicial Gazette and the website of the highest court.

On October 20, the National Electoral Council announced the holding of the consultative referendum on December 3, after the National Assembly delivered the request for this consultation to the Electoral Branch.

The Parliament’s request was the result of the approval, in Plenary session, of calling for said referendum based on article 71 of the Constitution. On October 23, the governing body for electoral matters unanimously approved the five questions.
