TSJ ordered CNE to hold a new election for Governor in Barinas

The Electoral Chamber of the Supreme Court of Justice (TSJ) ordered the National Electoral Council (CNE) to hold new elections for the position of Governor in Barinas on January 9, 2022.

The ruling, which declared the constitutional protection action filed as valid, indicates that are rendered without effect all the procedures and acts carried out in accordance with the Electoral Schedule, in the process carried out in Barinas state, regarding the election of the position of Governor of said entity, on November 21, 2021, as of the submission of the applications, inclusive, to guarantee the collective rights of the citizens of the territorial entity.

The decision adds that is ordered the realization of a new electoral process in Barinas in order to guarantee the right to active and passive participation of those who attended the electoral event without prejudice to the fact that even when the projections consigned by the CNE give a Percentage of votes in favor of candidate Freddy Superlano of a 37.60% compared to 37.21% of votes obtained by candidate Argenis Chávez, it is considered that the condition of ineligibility of Superlano, already identified, according to Resolution No. 01-00-000334 dated August 17, 2021 issued by the Comptroller General of the Republic, violates the principles of equality, equity and transparency in the participation of the candidates in the electoral offer, as well as of the voters in the exercise of active suffrage.
