TSJ rejects report of alleged human rights experts on Venezuela

The Magistrates of the Supreme Court of Justice, the highest instance of the Judicial Power, expressed their most forceful rejection of the report prepared by a parallel commission promoted by the self-called Lima Group, on the situation of Human Rights (HR) in the country.

Through a statement, the Venezuelan Supreme Court warned that the main objective of these promoters of hatred is none other than to use human rights as this political tool to attack democratic institutions and seek new and greater attacks against the country.

He recalled that during the 42nd Period of Sessions of the Human Rights Council, “they imposed this mandate, whose main objective is to question the legitimate government of Venezuela and its institutions”.

Likewise, the Supreme Court assured that this report was based on an irritic resolution that violates the principles of international law, such as the right to sovereignty, the right to self-determination of peoples, non-interference in internal affairs and integrity territorial, and also violates the main pillars of multilateralism, such as genuine dialogue and cooperation.

He also stressed that this report was carried out in a unilateral and biased manner, “evidencing itself with a frank manipulation and misuse of the international human rights system, and neutralizing the work of the UN Human Rights Council, preparing a parallel report, with the purpose of annihilating the true image of the guarantees to human rights promoted by the Bolivarian Republic of Venezuela”.

The Communiqué read by the president of the Supreme Court, Magistrate Maikel Moreno, stressed that this report intends to subrogate the protocols agreed with the United Nations High Commissioner for Human Rights, on such sensitive issues, “turning this supposed Independent Mission into a new mechanism of aggression, which aims to outline and publicize a series of biased and unilateral assessments of the human rights situation in the country”.

In the same way, the highest court of the country agreed with other instances that affirm that this report lacks the essential protocols for the verification and consolidation of the information obtained, since it was not carried out in the territory of the Bolivarian Republic of Venezuela, and was based on depositions of alleged victims and witnesses promoted anonymously and unilaterally, violating the elementary principle of transparency that should characterize any action of the United Nations Human Rights Committee.

Furthermore, this report does not foresee the real verification of the legal situation of the alleged victims.

The Court warned that its work was not promoted by the majority of the conglomerates of the States party to the United Nations, “which makes its source questionable, as it lacks the necessary legitimacy to sustain and promote this type of document”.

The Bolivarian Republic of Venezuela is a State that guarantees peace and the progressiveness of human rights from the constitutional point of view, not only does it grant a preponderant role to fundamental rights, but it subordinates all activities of the State to respect and the guarantees of these rights, the statement refers.

“We regret that these practices, which are outside rationality and good faith, which govern international relations between States and multilateral organizations such as the United Nations, serve as instruments to try to hinder and destroy the dialogue processes established between the National Government and the opposition, for the peaceful and democratic resolution of its conflicts”.

In his opinion, it is evident that these actions are promoted by internal and external enemies of Venezuela, “who with double standards in questioning the application and development of human rights in our country, hiding their serious social crisis and the erosion of these rights in their own territories”.

TSJ’s position maintains that these actions are part of an old strategy of aggression against the Bolivarian Republic of Venezuela and its institutions, which have been coordinating tangible efforts to consolidate a culture of peace and understanding among Venezuelans.

“We alert the Venezuelan people and the international community that the main objective of these promoters of hatred is none other than to use human rights as this political tool to attack democratic institutions; However, despite these unfounded attacks that seek new and greater aggressions against our Republic, the Supreme Court of Justice will continue to be the guarantor of political stability and peace, contributing to the consolidation of the social State of law and justice that our Constitution and at the same time favoring the effective exercise of human rights as an indispensable practice for the consolidation of the objectives enshrined in our Magna Carta”.
