The Minister for Foreign Affairs, Justice and Peace, Néstor Reverol, reported this Thursday that Article 42 of the Organic Law Against Organized Crime and Financing of Terrorism will be applied to the so-called “trocheros” (trail smugglers), for promoting illegal immigration and trafficking of people from Colombia.
“These people who are committing this crime are going to have the law applied to them. It is clearly expressed in Article 42; They will be sent to the El Dorado prison immediately, in order to guarantee the health of our people and prevent the entry of infected people from the neighboring country”, he said.
Reverol explained that such action seeks to circumvent the homeland by entering the national territory “through “the green trails and pathways” to those who have been infected, to continue spreading the virus in Venezuela and creating a collapse in the health system.
“We have declared war on the trocheros, the entire country needs to join to denounce the trocheros through the trocheros2020@gmail.com e-mail address, to denounce those who illegally are passing people”, he said.
Article 42 of the Law against organized crime, establishes that: Who as an integral part of an organized crime group promotes, induces, favors, constrains, facilitates, finances, collaborates, by action or omission or in any other way participates in the entry or exit of foreigners or illegal trafficking of people from the territory of the Republic, without complying with the legal requirements to obtain economic benefit or any other benefit for himself or for a third party, will be punished or imprisoned for eight to twelve years.
Furthermore, “the consent of the taxable person does not constitute grounds for exclusion of criminal responsibility for the facts referred to in the preceding articles. Nor is it the consent that, for this purpose, is granted by the ascendant, spouse, brother, sister, tutor, curator, person in charge of education or guardian.
Also, it includes “any other person living with the taxpayer of trafficking, minister or minister of some cult or official or civil servant, public employee or public employee, remaining the possible criminal liability of the latter in case it is determined that still in commission by omission, they intervened in trafficking”, quotes the Article.
Similarly, the President of the Republic, Nicolás Maduro, urged during an act of promotion, decoration and joint graduation on the occasion of the National Police Day, that the Bolivarian National Police (PNB) be incorporated to locate the trail smugglers, and networks that organized.
