The constitutional lawyer, Hermann Escarrá, assured that, as established by the Constitution of the Bolivarian Republic of Venezuela, the extension of the decree the State of Exception of Alarm is completely legal, since the efforts of President Nicolás Maduro are focused on defending the health of the people in the face of the coronavirus pandemic.
He explained that the first declaration of the State of Exception contemplates a 30-day period that was met as part of the effort to defend the health of the people of Venezuela in the face of the pandemic, where decisions had to be made related to the restriction of guarantees such as freedom of circulation.
He also added that his judgment is totally correct, the decision to extend the State of Alarm for 30 more days is well justified because the Head of State still has to make decisions about urgent and necessary mechanisms amidst the fight against the new coronavirus:
“This is not just a pandemic, but there is an extremely serious issue that affects the right to life and, of course, health in the first place, but which also affects social, economic, and institutional situations in each of the States”, he justified.
He praised that the measures taken by the Venezuelan State to combat this virus have been effective and taken with great caution. “In the messages of the President, you can see the concern for us to keep the indexes in a very careful and prudent way so that this does not develop for us as in other countries”, he added.
He stressed that in the US, Brazil and Colombia, the measures adopted have not been effective and therefore there have been exponential growths both in the number of infections, and in those killed by this virus.
Mercenary incursion violates the full sovereignty of the Homeland:
The also constituent, Hermann Escarrá, rejected the claims of the extreme right wing to violate the full sovereignty established in Article 1 of the Venezuelan Constitution and assured that this is an extremely serious event by assuming a triangular situation in the geopolitical order by involving Colombia and USA in planning these violent acts.
“Thank God we have a clause from the Constitution of 99′ and since the arrival of the Bolivarian Revolution, which is the civic-military union, which has allowed a very efficient action by the Venezuelan security forces, both the military and the police, but it has also allowed a great efficiency of social intelligence”, he highlighted.
Referring to the contract signed by Juan Guaidó and the Silvercorp company, he assured that it is an unusual pact from which the sovereignty of the Republic is sold for 212 million dollars so that in one year and five months would happen a scenario of assassinations, bloodbaths and actions of the so-called lethal forces, whose first objective was the President of the Republic.
