Supreme Court declared nullity of challenge to Hydrocarbons Law reform

The Constitutional Chamber of the Supreme Court of Justice (TSJ) dismissed the action seeking to annul the recent reform to the Hydrocarbons Law on grounds of unconstitutionality, according to the ruling issued by the high court.

The ruling upholds the validity of the Hydrocarbons Law published in Extraordinary Official Gazette No. 6,978. The decision corresponds to Judgment No. 0827, under the authoring of Magistrate Tania D’Amelio Cardiet, in which the court affirmed its full jurisdiction to resolve the consolidated actions in case files No. 26-0144 and No. 26-0697, thereby denying the requested precautionary suspension.

In a complementary resolution, the Constitutional Chamber issued Judgment No. 0826 regarding case file No. 26-0321, declaring inadmissible the action of constitutional protection filed by attorneys Christian Wagner Canache Aguiar and Jesse Alejandro Canache Aguiar.

That action challenged administrative and operational measures taken by Petróleos de Venezuela (PDVSA) and the Ministry of People’s Power for Hydrocarbons within the framework of applying current legal regulations.
