Government of the Netherlands violated Seat Agreement between ICC and the host State and prevented the visit of a Venezuelan delegation

The Executive Vice President of the Bolivarian Republic of Venezuela, Delcy Rodríguez, denounced before the international community that the Government of the Netherlands prevented the transfer of the Venezuelan delegation, which would assist to The Hague to comply with a commitment established with the International Criminal Court:

Due to the Understanding Memorandum signed on November 3, 2021 between the President of the Bolivarian Republic of Venezuela, Nicolás Maduro and the prosecutor of the International Criminal Court, Karim Khan, a work meeting was arranged for December 14 2021. However, the Government of the Netherlands obstructed the transfer of the delegation, which would travel to fulfill the special mission”, explained Vice President Rodríguez.

The high authority of the Bolivarian Government, detailed that the Government of the Netherlands demanded conditions of impossible fulfillment that violate the entire international legal order; she showed evidence that proves that the Venezuelan delegation would travel on a Conviasa plane on an official diplomatic flight, which also has the permission of third-country flight operators.

Delcy Rodríguez, a specialist in international law, explained that the Government of the Netherlands violated the Agreement Relating to the Seat between the ICC and the Host State, the United Nations Charter, the Vienna Convention and the Treaty of Immunities and Privileges, by placing unusual conditions on the Bolivarian Republic of Venezuela.

Faced with this situation, Venezuela will inform the UN Secretary General and the President of the Assembly of States party to the Rome Statute, and offered options so that prosecutor Khan could hold the planned work meeting with the Venezuelan delegation, in another country of easy transfer for him:

Venezuela remains on the path of respect for international regulations, and that is why it raised this energetic protest, due to the terrible breach of international agreements; Venezuela is a country with a tradition of strict adherence to national and international regulations, and in this case, the Bolivarian Republic, a State party to the Rome Statute, must be allowed to comply with its actions, as contemplated in the Headquarters Agreement signed by the ICC and the Netherlands”, concluded Vice President Delcy Rodríguez.
