TSJ declares as Constitutional State of Exception and Economic Emergency

The Constitutional Chamber of the Supreme Court of Justice (TSJ) declared this Friday the constitutionality of Decree No. 4,396 in which the State of Exception and Economic Emergency is declared throughout the national territory.

In the ruling – quoted in a press release – the Constitutional Chamber asserted that the conclusion of the legislative period in contempt is given on January 4, 2021, and the National Assembly elected in the elections of December 6 and 9, 2020 began the first period of sessions on January 5, 2021, for the 2021-2026 legislative term and, consequently, fully assumed the competencies, powers and faculties granted by the Constitution of the Bolivarian Republic of Venezuela.

In accordance with the provisions of Article 339 of the Fundamental Charter, in accordance with the provisions of Article 26 of the Law on States of Exception, the decree must be sent to the National Assembly within eight continuous days following the one in which it was dictated.
