TSJ declared constitutionality of the State of Exception and Economic Emergency

The Constitutional Chamber of the Supreme Court of Justice (TSJ) declared through Decree No. 4,090, dated January 5, 2020, the constitutionality of the declaration of the State of Exception and Economic Emergency throughout the national territory.

The measure was ratified in judgment No. 0002-2020 of the High Court Chamber, with a presentation by its president, magistrate Juan José Mendoza, in which he also declared null, non-existent and ineffective any act in which the National Assembly in contempt intends to disapprove the Decree of State of Exception.

Likewise, he reiterated that the acts emanating from the parliament, including the laws that are sanctioned, while remaining in contempt of the sentences of the High Court of the Republic are manifestly unconstitutional and, therefore, absolutely null and void of any legal validity and effectiveness.
