The Supreme Court of Justice (TSJ) declared on Thursday the constitutionality of the decree of State of Exception and Economic Emergency No. 2,667, issued by the President of the Bolivarian Republic of Venezuela, Nicolás Maduro, on January 13, 2017 in a national joint broadcast through its annual message to the Nation.
According to the ruling number 4/2017: “The highest court in the country, recognizing that the determination of the National Executive is oriented to the well-being of citizens living in the Republic, supported the conformity of the Decree with respect to the Constitutional Text, as an instrument that enables the adoption of urgent, forceful, exceptional and necessary measures to ensure the full enjoyment of their rights by the population, preserve internal order and timely access to goods, services, food, medicines and other essential products for life.”

“Given the extraordinary circumstances that the Nation is experiencing in the social, economic and political sphere that affects the constitutional order and, consequently, peace and security in the geographical space, the Supreme Court of Justice (TSJ) declared the constitutionality of the Decree Of State of Exception and Economic Emergency No. 2,667, issued by the President of the Bolivarian Republic of Venezuela, on January 13, 2017.
According to Judgment No. 4/2017, the country’s highest court, recognizing that the determination of the National Executive is oriented towards the well-being of citizens living in the Republic, supported the decree’s compliance with the Constitutional Text, as an instrument that makes possible to take urgent, forceful, exceptional and necessary measures to ensure the full enjoyment of the rights of the people, to preserve domestic order and to provide timely access to goods, services, food, medicines and other essential products for life.
In addition to the various legal bases examined, the binding decision as well as the generality of the judgments issued by the Constitutional Chamber, contains the analysis of the Decree, which has been in force since it was handed down, whose aim is referred to the protection of the Fundamental Text, the State, its Institutions and the People.
