ANC approves lifting the parliamentary immunity of Requesens and Borges

The National Constituent Assembly (ANC) unanimously approved this Wednesday in an ordinary session to lift the parliamentary immunity of deputies of the National Assembly – in a situation of judicial contempt since 2016 – Juan Requessens and Julio Borges, for their involvement in the assassination attempt in state of frustration, against the President of the Republic, Nicolás Maduro, perpetrated last Saturday.

At the beginning of the session, a document was read by the Full Chamber of the Supreme Court of Justice (TSJ) declaring as appropriate the prosecution of Requesens, after determining that there are sufficient elements of conviction to estimate the commission of crimes of a permanent nature.

The president of the ANC, Diosdado Cabello, said Borges and Requessens are being investigated for the crimes of continued public incitement, treason, intentional homicide in degree of frustration, intentional homicide with treachery and futile motives in degree of frustration, terrorism, financing of terrorism and association to commit crimes.

The president of the Constitutional Commission, Hernán Escarrá, explained under the precepts of the Constitution of the Bolivarian Republic of Venezuela, the arguments required to approve the suspension of the immunity of Borges and Requesens.

He stressed that parliamentary immunity is not an extraordinary or exceptional protection that puts the parliamentarian in a situation of not being sanctioned, or not be judged in the face of a punishable act: “Immunity refers to the commission of a punishable act and if it is common and is especially serious, then the intervention must be immediate, always before the Supreme Court”, he explained.

“The institutions of the Venezuelan State are subordinated to the National Constituent Assembly, which will decide the fate of its holders with powers and competencies. That is (its) supra-constitutionality”, he detailed.

Also, the president of the Human Rights Commission of the ANC, María Alejandra Díaz, urged the Government of the United States of America (USA) to carry out an investigation to determine the participation of the Peruvian presenter based in Miami, Jaime Bayly, who affirmed to know beforehand the planning of the assassination attempt, and who warned that there would be more.

For his part, the president of the plenipotentiary body indicated that with the unanimous approval of lifting the parliamentary immunity of Requesens and Borges, they allow the trial and the investigations into the failed attempt against the national president may proceed.

“The trial and investigations will continue, these are the first two that appear as indicated, but the investigation continues, justice will arrive, and with everything, to anyone who is involved”, he concluded.
