Supreme Justice Court ratifies Board of Directors of the National Assembly

The Constitutional Chamber of the Supreme Justice Court (TSJ) ratified this Tuesday the Board of Directors of the National Assembly (AN) appointed on January 5, 2020 for the 2020-2021 parliamentary term, comprised of deputies Luis Eduardo Parra Rivero as President; Franklin Duarte as First Vice President, and José Gregorio Noriega as Second Vice President.

The sentence, with a presentation by magistrate Juan José Mendoza Jover, prohibits the installation of a parallel or virtual parliament, which has no legal effect, and establishes that any public or private person who provides or gives space for it will be considered in contempt, and any act exercised as such is void.

Following, the full text of the sentence:

“The Constitutional Chamber of the Supreme Court of Justice (TSJ) declared valid the Board of Directors of the National Assembly (AN) appointed on January 5, 2020 for the 2020-2021 parliamentary term, which is made up of deputies Luis Eduardo Parra Rivero as President, Franklin Duarte as First Vice President, and José Gregorio Noriega as Second Vice President.

According to the ruling, it is prohibited the installation of a parallel or virtual parliament, which has no legal effect, and establishes that any public or private person who lends or gives space for it will be considered in contempt, and any act exercised as such is void.

Decision No. 0065-2020, with a presentation by magistrate Juan José Mendoza Jover, responded to the request for constitutional protection filed by citizen Enrique Ochoa Antich against the National Assembly, a request that was declared inadmissible in limine litis considering that there is no outside action. of the framework of the constitutional and legally attributed competence of the new Board of Directors of the AN for the period 2020-2021, as well as no violation of any constitutional right by its legitimate members.

The opinion also ordered to send a certified copy of the file and the ruling to the Public Ministry, for the corresponding legal purposes in relation to the actions of citizen Juan Gerardo Guaidó Márquez.
