Bolivarian Government repudiates external interference by Freddy Guevara case

The Bolivarian Republic of Venezuela, through a communiqué, demanded the immediate cessation of the attacks against its institutions and the Venezuelan people, as part of the campaign of disowning the constitutional authorities following the decision of the Full Chamber of the Supreme Court of Justice on the legal situation of deputy Freddy Guevara.

The Government of the Bolivarian Republic of Venezuela before the recent decision of the Full Chamber of the Supreme Court of Justice on the legal situation of Deputy Freddy A. Guevara C., expresses the following:

1. In accordance with the Social Rule of Law and Justice in force in Venezuela, and in compliance with the principle of separation of powers, the Bolivarian Government takes note of the decision of the Judiciary and maintains its conviction that national institutions will continue to act in accordance with the Venezuelan legal system, to the full force of democracy and within the strictest respect for constitutional rights and guarantees.

2. The Bolivarian Government is determined to guarantee the political and institutional stability of the Republic, since this constitutes one of the essential purposes of the State. In this sense, it will provide all the collaboration required by the Public Prosecutor’s Office or the National Courts in the instance or moment that is required.

3. The Venezuelan Constitution recognizes parliamentary immunity as an essential principle for the safeguarding of the legislative function, and establishes the procedures in case their acquiescence is required. Similarly, the Venezuelan doctrine and jurisprudence is clear when warning that the preliminary hearing of merit against high officials of the State is not appropriate if it is a crime in flagrante delicto, and this has been determined by the Supreme Court of Justice.

4. For the Venezuelan people, the actions of deputy Freddy Guevara and his presumed responsibility during the violent acts of political destabilization known as the “guarimbas” (riots), which left a painful balance in human losses and material damages between the months of April, are public and notorious. and July 2017. However, it corresponds to the Ordinary Courts of the Republic the confirmation, or not, of this presumption and the actions that it dictates in exercise of the exclusive power of administration of justice.

5. According to Venezuelan laws, Deputy Freddy Guevara has all the legal guarantees to prepare his defense according to due process as established by the Constitution and laws.

6. The Bolivarian Government also expresses its strong condemnation of the permanent acts of interference in the internal affairs of Venezuela by Governments, organizations and individuals who arrogantly arrogate to themselves a pretended and non-existent license to protect the Venezuelan democracy and its institutions.

7. The Bolivarian Government demands the immediate cessation of the aggressions against the people and the Government of Venezuela and its institutions, and denounces the campaign of instigation to the ignorance of the constitutional authorities, whose evident purpose is to encourage and reactivate the destabilization and violence in the country.

8. Firm in the purpose of deepening Venezuelan democracy, the Bolivarian Government calls the people to stay focused on the process of municipal elections whose results will defeat any attempt of aggression against the social and political peace that our Homeland enjoys today.
