The Supreme Court of Justice (TSJ) declared this Tuesday that the National Budget 2017 must be presented by the President of the Republic to the Constitutional Chamber of the Supreme Court of the country, under the form of a decree that will have a rank and force of law, in view of the contempt of the board of the National Assembly against the Judiciary sentences.
“The President of the Republic shall submit the national budget to this highest court of constitutional jurisdiction, within five (5) days following the notification of this decision, in the form of a decree that will have a rank and force of law” expresses the judgment issued by the Supreme Court of Justice (TSJ).
The ruling also orders that: “In this present case does not proceed the budgetary reconduction and, therefore, the National Assembly may not alter at any time the budget items, nor pretend to obstruct or affect the integrity of the provisions laid down in the relevant decree of a National budget “.
Likewise, the Supreme Court indicated that the decree of the National budget will be subject to control by the Constitutional Chamber, “as provided in paragraphs 3 and 4 of Article 336 of the Constitution of the Bolivarian Republic of Venezuela, as part of the guarantee system provided for in the basic text, without prejudice to the powers inherent in the Citizen Power and the social comptrollership in this matter. ”
President Maduro said last Oct. 3 that he would send a letter to the highest court in the country to see the most expeditious way to pass the national budget by 2017, as Parliament has been held in contempt.
